Intellectual Property Policy

Last Updated: 14/02/2025

1. Introduction

Harry & Co Jewellery protects its intellectual property, covering original jewellery designs, branding elements, and creative assets. This policy details our legal rights under the Copyright Act 1968 (Cth) and the Trade Marks Act 1995 (Cth) and defines conditions for marketing customer-approved designs.

2. Ownership of Intellectual Property

All jewellery designs, ornamental metalwork, gemstone settings, sketches, prototypes, photographs, and trade identity elements developed by Harry & Co Jewellery remain the exclusive property of the business. These include:

  • Original jewellery collections and bespoke creations.
  • Trade dress, brand insignia, logos, and product photography.
  • Promotional and marketing content across digital and print media.

3. Unauthorised Use and Reproduction

The unauthorised replication, alteration, or redistribution of our jewellery designs or brand elements is strictly prohibited. This includes:

  • Direct imitation or reproduction of our creations for resale or personal use.
  • Use of brand identifiers such as logos and product images without written approval.
  • Production of derivative works based on our designs or collections.

Violations of these protections may result in legal action, including cease-and-desist orders and financial penalties under Australian intellectual property laws.

4. Custom Designs and Customer Collaboration

For bespoke jewellery designed with customer input:

  • Harry & Co Jewellery retains full intellectual property rights over the final jewellery design, including its artistic and technical specifications.
  • Customers are prohibited from reproducing or commissioning third parties to replicate custom pieces without explicit written permission.
  • Any modifications or adaptations of custom designs for future collections remain the sole discretion of Harry & Co Jewellery.

5. Showcasing Customer-Approved Designs

We may feature customer-approved jewellery pieces in our promotional materials, including:

  • Website product galleries and online storefronts.
  • Social media campaigns and digital advertisements.
  • Print media, catalogues, and industry showcases.

Customers wishing to keep their commissioned designs private must notify us in writing at the time of purchase.
